Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the MediShield Auditor website at medishield.xyz and its features (the "Service"), operated by MediShield ("we", "us"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service does

MediShield helps you review a medical bill for common billing errors and potential No Surprises Act issues. All analysis runs locally in your browser. You may optionally purchase a generated "Formal Dispute PDF" for a one-time fee. The Service is a self-help tool that organizes information you provide; it does not submit disputes, contact providers, or interact with insurers on your behalf.

3. Not legal, medical, or financial advice

The Service, including any analysis, flags, savings estimates, and generated documents, is provided for general informational and educational purposes only. It is not a substitute for professional advice from a licensed attorney, medical billing advocate, accountant, or insurance professional. We do not guarantee that any bill is or is not erroneous, that any charge violates any law, or that using a generated document will produce any particular outcome. You are solely responsible for decisions you make based on the Service.

4. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service or make a purchase.

5. Payments and refunds

• The Formal Dispute PDF is sold for a one-time fee of US $5 (or as otherwise stated at checkout). Prices are subject to change, but changes will not affect a completed purchase.
• Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms. We do not receive or store your full payment card details.
• Because the product is a digital good delivered immediately upon payment, all sales are final and non-refundable, except where a refund is required by applicable consumer-protection law. If you were charged in error or the document failed to generate, contact us and we will make it right.

6. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt or reverse-engineer it, circumventing the payment flow, using it to violate any law, or submitting content you have no right to use. We may suspend access for conduct that harms the Service or other users.

7. Intellectual property

The Service, including its design, text, and software, is owned by us or our licensors and is protected by intellectual-property laws. The dispute document you generate from your own data is yours to use for your personal, non-commercial purposes.

8. Third-party services

The Service relies on third parties including Stripe (payments), Google Analytics (analytics), Cloudflare (backend), and Vercel (hosting). We are not responsible for the availability, content, or practices of these third parties, which are governed by their own terms and policies.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of savings, data, or opportunity, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $5. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your misuse of the Service or violation of these Terms.

12. Changes to the Service and Terms

We may modify or discontinue the Service at any time, and we may update these Terms by posting a revised version with a new "Last updated" date. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable consumer law gives you the right to bring proceedings in your own jurisdiction.
